How much Gold can an NRI bring ?
  • An NRI can bring gold into India, once in six months, in any form upto 10 kilograms as part of baggage - provided that he has stayed abroad for a continuous period of at least six months prior to his return to India.
  • The custom duty payable on this gold brought by NRI is Rs.220/- per 10 grams of gold and it is to be paid in convertible foreign exchange.

How much Silver can an NRI bring ?
  • As part of personal baggage, an NRI can bring silver upto 100 kilograms.
  • The custom duty payable on the silver brought by NRI is Rs.500/- per kilogram and it is payable in foreign currency.

Sale and Tax treatment thereof:
  • The gold/silver brought in by NRI can be sold in India and the profit earned thereof attracts tax liability.
  • If you wish to take advantage of the business opportunity, the profit earned will be treated as business profit. The cost and expenses incurred for the sale can be deducted from the sale proceeds and tax will be applicable at the normal applicable rates.
  • If gold/silver is acquired as a capital asset, the income will be treated as short term or long term capital gain, depending on your period of holding. If you held for less than 3 years it will be short term capital gain, tax will be at the normal applicable tax rate. If it is held for more than 3 years the capital gain will be long term and you can get some tax benefits.
  • Tax will be payable @ 20% only on the long-term capital gain after taking the benefit of cost indexation.
